The Contract Amendment means that both Parties negate all current and historical claims, which have arisen due to delays in the Project B1 implementation.
“B1 is a crucial Project and delays in its implementation affected the entire decommissioning process, which resulted in additional costs. Signing the Contract Amendment resolves all remaining issues. This will positively influence the entire decommission process.” – said the Director General Darius Janulevicius.
By signing the new Contract Amendment both Parties agreed to resolve all claims that have been negatively influencing the Project implementation and were arisen before signing the Contract Amendment, in a peaceful manner and under the clauses of the original Contract.
Another important outcome of the Contract Amendment is making the new schedule and the deadline for the Project B1 legally abiding. INPP gains the right to control the progress of the Project implementation. Moreover, in accordance with the new schedule the deadlines remain the same. This means that Hot Trials will be completed in the middle of 2017 and the new Facticity will start operating in autumn 2017.
“At the moment, the Contractor is implementing the Project in accordance with not legally abiding schedule. Therefore, in a situation where work is delayed INPP is unable to apply sanctions against the Contractor. The Contract Amendment of the Project B1 makes the implementation schedule legitimate and creates strict deadlines for milestones together with the deadline for the Project implementation. If the Contractor does not implement works under the schedule agreed, INPP will gain legal rights to apply penalties for delays.” – said D. Janulevičius.
Among the main consequences of the discussion, which lasted more than a year, it must be noted, that both sides managed to keep the well-intentioned relationship and agreed to carry on work based on cooperation and to concentrate efforts on milestones that must be achieved in order to complete the Project.
It must be highlighted, that the Contract Amendment does not increase the cost of the Contract. The Contractor does not acquire rights for any additional payments.
Contract Amendment of the Project B1 was signed at the European Bank of Reconstruction and Development (EBRD) headquarters in London.
Project B1 is financed by the by the Ignalina International Decommissioning Support Fund (IIDSF) administrated by EBRD. Donor Assembly governs the Ignalina International Decommissioning Support Fund. Donor countries – Austria, Belgium, Denmark, Finland, France, Germany, Ireland, Luxembourg, the Netherlands, Norway, Poland, Spain, Sweden, Switzerland and European Commission.
