On 15th February 2011, the Supreme Arbitration Court of the Russian Federation confirmed the decision of the Federal Antimonopoly Service (FAS Russia) about the size of the fine imposed upon “Gazprom Neft” OJSC.
In 2009 FAS Russia fined “Gazprom Neft” OJSC for violating Article 10 of the Federal Law “On Protection of Competition”.
The company abused its market dominance by creating discriminatory conditions for independent participants of the wholesale market of oil products. Actions of “Gazprom Neft” OJSC also resulted in unreasonable growth of prices for motor petrol, aviation fuel and lubrication materials and diesel fuel in October 2008 - February 2009 года.
Recognising violations of Article 10 of the Federal Law “On Protection of Competition” constituted the grounds for FAS Russia to impose the fined under Article 14.31 of the Code of the Russian Federation on Administrative Violations.
