According to lawyers at the international law firm DLA PIPER representing the interests of the energy holding in the case, an announcement was officially made by the country’s public prosecutor's office on December 22, 2012, at a court session in the capital Tbilisi, as a result of which the CEO of JSC Telasi, Devi Kandelaki, was released on bail.
INTER RAO UES Group states that Georgia’s public prosecutor did not recognize the distinction between the advance tax ruling which was necessary to complete agreements previously achieved with the government of Georgia in 2011-2012 as part of JSC Telasi’s debt restructuring (INTER RAO UES Group has been waiting for an advanced tax ruling from the tax authorities of Georgia since April 2012) and the tax agreement itself which can only be signed with the Group’s enterprises in 2013.
Both procedures are pubblic, provided for by the legislation of Georgia, and based on an offer by the taxpayer in connection with which the proposal to sign tax treaties was received from the Company.
The aim of fixing tax obligations, as well as the optimization of management and production costs of the Group’s companies in Georgia, was to define long-term tariff rates and their possible reduction for end-consumers, including the public.
At the same time, the Company considers the statement of the prosecutor's office about, allegedly, "forgiven" tens of millions of lari in taxes to be contrived, since at the time of the conclusion of the consulting contract contested by the prosecution no decision by the tax authorities to charge additional taxes was in existence.
In connection with this, INTER RAO UES Group does not preclude the possibility of reviewing the accords reached in the beginning of 2012 with regard to restructuring of JSC Telasi’s debt obligations to the majority shareholder. INTER RAO UES Group also states that in the current circumstances the settlement of questions of taxation is a prerequisite for tariff revision.
